eLUNCH TERMS AND CONDITIONS

By using this website you agree to the Terms and Conditions below. If you do not agree to be bound by these Terms and Conditions you must stop using this website immediately. eLUNCH may amend, update or change this web site including these Terms and Conditions at any time without prior notice. By continuing to use this website, you agree to be bound by these amendments.

1. General terms and conditions for the ordering and pick-up/delivery of eLUNCH products

Prices and offers may be valid for a limited period only.

In-store offers and promotions are not necessarily available for online ordering.

Where an order is for 'pick-up', the customer is entirely responsible for arranging for the order to be picked up from eLUNCH at 59 Victoria Street at the time selected when ordering. eLUNCH is under no obligation to refund payment if an order is not picked up, and is not responsible for products deteriorating if they are not picked up at the time selected. Please note that pick-up times are targets only, and while eLUNCH always endeavours to have orders ready on time, we do not guarantee these times as delays may be experienced.

2. Delivery of eLUNCH products

eLUNCH delivers within specific time periods as detailed on our menus and delivery information page. We do not deliver outside of these times except by special arrangement. Please note that the delivery times are estimates and targets only. eLUNCH does not guarantee delivery times as delays may be experienced.

Customers are responsible for providing an accurate delivery address and any other details that are necessary to ensure the order is delivered to the appropriate person and location. eLUNCH accepts no responsibility for orders that cannot be delivered due to inaccurate delivery details or insufficient information, and is under no obligation to refund payment for such orders.

Where an order is to be delivered to an office/premises that does not have public access, the customer is responsible for notifying eLUNCH (in the delivery information section or via email) of this, and providing an accurate phone number so that eLUNCH delivery staff can notify the customer of their arrival. The customer must then collect the delivery promptly. eLUNCH accepts no responsibility for orders that cannot be delivered because of public access restrictions that eLUNCH has not been made aware of, or for the customer's failure to meet delivery staff promptly. In such cases, eLUNCH is under no obligation to refund payment.

Lunch Orders

Delivery is not available in all areas. eLUNCH provides a lunch delivery facility within a specific part of the Christchurch central business district, as shown on our delivery information page. Deliveries outside of this area are subject to confirmation by email and may incur an additional delivery charge at the discretion of eLUNCH.

A minimum order value of $15.00 is required for free delivery of lunch orders within eLUNCH's lunch delivery zone. For orders under $15, a maximum $3 delivery fee will apply (that is, a $3 fee will be added to the order value, or, if the order is within $3 of the $15 minimum order, the total cost will be taken up to $15).

Catering Orders

Delivery is not available in all areas. eLUNCH provides a catering delivery facility within the Christchurch central business district, as shown on our delivery information page. Deliveries outside of this area are subject to confirmation by email and may incur an additional delivery charge at the discretion of eLUNCH.

A minimum order value of $40.00 is required for free delivery of catering orders within eLUNCH's catering delivery zone. For orders under $40, a maximum $7 delivery fee will apply (that is, a $7 fee will be added to the order value, or, if the order is within $7 of the $40 minimum order, the total cost will be taken up to $40).

3. On-line ordering facility

Placing orders

eLUNCH agrees to execute all orders in accordance with their terms but reserves the right to reject any order at its absolute discretion.

If you place an order online you acknowledge and agree that eLUNCH is entitled to assume that any order which is placed with eLUNCH via the website using your details and which is accepted by eLUNCH is a valid order on your behalf for which you are obliged to pay.

You acknowledge:

i) eLUNCH provides this online ordering facility in good faith but does not guarantee its performance or availability;

ii) the online ordering facility may be unavailable from time to time for regularly scheduled maintenance and/or upgrades;

iii) eLUNCH cannot warrant against delays or errors in transmitting data between you and eLUNCH, including orders, and you agree that to the maximum extent permitted by law, eLUNCH will not be liable for any losses which you suffer as a result of the facility not being available or for delays or errors in transmitting orders.

Registration

You can choose to register with the eLUNCH website, whereby we hold your contact details and/or details of your last or preferred orders. We do not retain credit card or other payment details. eLUNCH does reserve the right to reject a registration.

eLUNCH reserves the right to terminate your account if it learns that you have provided false or misleading registration information, interfered with other users or the administration of eLUNCH services, or violated these Terms and Conditions.

You may not at any time be the holder of more than one registration with eLUNCH. eLUNCH will have the right to terminate any registrations that are found to be duplicates, and to recover from the registered persons any benefits that have been obtained through these registrations.

Website Information

eLUNCH will endeavour to keep this website up-to-date and will endeavour to notify you if an advertised product that you have ordered is not available. Price information is subject to change without notice. eLUNCH is not liable to you or anyone else if errors occur in the information on this web site or if that information is not up to date.

4. Links to other web sites

eLUNCH may provide links to web sites not operated by eLUNCH. These linked sites are not under the control of eLUNCH, and we are not responsible for the privacy practices or content of companies linked to our web site.

5. Intellectual Property Rights

All material contained on this web site is the property of eLUNCH Ltd and protected by copyright. Except as permitted by relevant copyright legislation or with the prior written approval of eLUNCH, no part of this website may be otherwise used, reproduced, published, stored in any electronic form, altered, transmitted in any form or by any means in whole or in part.

6. Limitation of Liability

In relation to the purchase of any products or services through this website, then to the extent permitted by law:

i) eLUNCH will not be liable for any incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings;

ii) eLUNCH's direct liability in relation to the purchase of any product or service purchased through this web site is limited to the lesser of: 1) the replacement of any product purchased; and 2) the purchase price paid by you to eLUNCH for the product.

You agree to fully indemnify eLUNCH from any claim, cost, demand or damage (including legal costs on a full indemnity basis) incurred or which may be incurred arising from a breach by you of these Terms and Conditions.
